PIERRE, S.D.(HubCityRadio)- On Wednesday, the South Dakota House State Affairs Committee discussed HB1113. HB1113 dealt with prohibiting the use of state resources for the provision of lewd or lascivious content.
Prime sponsor of the bill was Represenatative Carl Perry of Aberdeen.
Perry told the committee that the bill would not eliminate drag shows at Board of Regents schools.
Last year the South Dakota House passed a similar bill(HB1116) that Representative Chris Carr of Sioux Falls was the prime sponsor. Carr explains to the committee the difference between that bill and the one Representative Perry presented.
Among those that testified against the bill was Samantha Chapman of the ACLU. Chapman believes this bill violates first amendment rights.
Legal scholar Brett Reese believes this bill is unconstitutional.
Representative Perry provided a response to the opposition.
Legislators on the committee expressed concerns about the bill. Representative Roger Chase of Huron questions why K-12 was eliminated from this bill.
Speaker of the House Hugh Bartels questions whether cross dressing would be allowed with this bill. Representative Carr offered a response.
Representative Will Mortenson of Pierre informed the committee that Board of Regents are putting rules in place regarding lewd behavior.
Mortenson came into the hearing thinking he was going to support the bill but changed his mind due to the testimony of Brett Reese.
The House State Affairs Committee sent it to the 41st day on a 7-4 vote effectively killing the bill.
