PIERRE, S.D.(KCCR)- The South Dakota Public Utilities Commission has denied the request of a Gettysburg grain buyer to Deliver grain on open contracts. In January P-U-C staff filed a complain against Banghart Properties L-L-C of Gettysburg on the grounds Banghart operated as a grain buyer without a license in 2022 and 2023. Attorney Rob Konrad says the situation is unique.
Staff Attorney Amanda Reiss told the Commission Banghart doesn’t have the proper licensing to continue with transactions.
Commissioner Chris Nelson motioned to deny Banghart’s request after nearly an hour and a half of discussion and testimony. Commmissioner Gary Hansen approved the motion but was conflicted about it.
The P-U-C took the unique action of allowing limited public comment from some impacted producers who attended the meeting. The motion to deny was unanimous by the Commission.
