ABERDEEN, S.D.(HubCityRadio)- Former Democratic U.S. Senate candidate for the 2022 election Brian Bengs has brought up an amendment to amend the South Dakota Constitution.  The amendment covers Article III and said “A measure approved by the electors may not be repealed or amended by the Legislature for seven years from the enacted date of the measure”.

Bengs now registered as Independent explains what motivated him to do this amendment.

One of the key words in his amendment is enacted.  Initially it was enforced but Bengs talks why he replaced that with enacted.

Bengs talks about why he chose to not have it changed in seven years instead of five years which is what North Dakota uses.

On Wednesday, South Dakota Attorney General Marty Jackley submitted his explanation for this proposed amendment.  You can read it here.  Bengs offered his thoughts on Jackley’s statement.

Bengs is looking for feedback from the public about his amendment.

You can submit comments now to either the Attorney’s General office.  The deadline for that is July 8th.

Comments can also be submitted to the Secretary of State’s Office with that deadline being July 18th.

Among those who support this amendment is the Libertarian Collin Duprel who ran against Congressman Dusty Johnson for the U.S. House seat in 2022.
