Advocacy group suing Noem over ‘Smile Texas’ posts

PIERRE, S.D. (KELOLAND) — South Dakota Governor Kristi Noem now faces a federal lawsuit over her five-minute video promoting a Texas dental firm she posted this week on social media accounts.

Travelers United filed the consumers-protection action on Wednesday in the federal court of Washington, D.C.

Noem has accounts on Truth Social, Facebook, X and Instagram. The suit states that she placed the Smile Texas content on all of them.

The advocacy group argues that Noem was acting as a social influencer and claims the video represents “a misleading and deceptive advertising case.”

The group wants the federal court to order Noem to stop advertising on social media without disclosing she is advertising and to pay Travelers United’s costs and unspecified amounts of punitive and compensatory damages.

KELOLAND News has requested a response from the governor’s communications director or press secretary.
