Bossly family file lawsuit against Summit Carbon Solutions

ABERDEEN, S.D.(HubCityRadio)- On Thursday, Jared Bossly along with his family filed a civil lawsuit in Brown County against Summit Carbon Solutions for two counts of trespassing, two counts of nuisance, and two counts of negligence.  They are seeking actual and/or punitive damages.  No figures released at this time.

This stem from incidents back in May and June of 2023.  May dealing with the issue of trespassing and nuisance on Bossly’s property when agents of Summit went into the property uninvited.  According to the Bossly’s lawsuit, the agents from Summit claim that they were acting within their scope of authority at all relevant times.

In June dealing with trespassing, nuisance, and negligence, Jared and Tara along with other neighbors were witnesses to employees of Summit Carbon Solution doing surveying using large equipment that the Bosslys allege caused significant damage to their property.  Equipment used was for drilling anywhere between 25-100 feet below the surface of the property.  Brown County Sheriff’s Office was dispatched for security reasons.

According to the lawsuit, Summit termed it as “geotech” or geotechnical activity and other alleged surveys or investigations.

The Bosslys are seeking a jury trial and no trial date has been set at this time.
