PIERRE, S.D.(HubCityRadio)- On Friday, the South Dakota House State Affairs Committee heard testimony on HJR5001. The bill would propose and submit to the voters at the next general election an amendment to the Constitution of the State of South Dakota, prohibiting the transfer of private property to a non-governmental entity for the sole purpose of economic development or increased tax revenue.
Prime sponsor of the resolution is District 23 Representative Spencer Gosch.
Among those testifying in favor was rancher Amanda Radke.
Emily Amin who represents Pacific Legal Foundation talks about how this to challenging the Supreme Court decision involving Kelo vs New London.
South Dakota Retailers Association President Nathan Sanderson was among those who opposed it. He talked about already the number of amendments already being considered for the 2026 general elections.
Sanderson looked ahead to other amendments that are being considered.
Darla Pullman Rogers with South Dakota Rural Development Association also opposed the resolution.
Representative Gosch rebuked claims made by those opposed.
The committee passed the resolution on a 10-3 vote. This now moves to the House floor to be heard next week.
