Juvenile petition filed in stabbing death

BROOKINGS, S.D. (KJJQ) – Brookings County States Atttorney Dan Nelson says a juvenile petition has been filed against a 15-year-old for Aggravated Assault and First-degree manslaughter.

The allegations stem from an incident that took place Saturday, September 28th, at a residence just outside the city limits of Brookings.

It was reported to the Sheriff’s office as a fight and stabbing at about 5:12 p.m. Saturday on the 4200 block of Western Avenue South. Thirty-seven-year-old Justin Proctor of Brookings had a single stab wound that would prove fatal.

Law enforcement found Proctor sitting inside a vehicle, going in and out of consciousness. Emergency medical treatment was administered and he was airlifted to a Sioux Falls hospital where surgery was performed.

They were unable to stabilize Proctor’s injuries and he died early Sunday morning. An autopsy concluded Proctor’s died as a result of the stab wound.

Law enforcement continued investigating and gathered additional eyewitness testimony. Nelson says they learned that the juvenile intended to cause bodily injury to the victim using a dangerous weapon.

The investigation indicates the juvenile and Proctor are related.

Is is possible the juvenile could be transferred to adult court.

The juvenile was taken into custody and has been detained. He’ll appear in juvenile court on Tuesday, Oct. 8.
