PHILIP, S.D.(KCCR)- A Rapid City man has been sentenced for his sixth Driving Under the Influence charge.
Haakon County State’s Attorney Thomas P. Maher says Sixth Circuit Judge Bridget Mayer sentenced 42 year-old Jahn Paul Formanek on Friday to the maximum sentence of 10 years in prison on the charge of Aggravated Driving Under the Influence, a Class Four Felony. Three of the 10 years were suspended by Mayer and Formanek was given credit for 142 days served in jail.
Formanek was arrested by Philip police back in August of 2022 near Lake Waggoner Road north of Philip. Photos of evidence in the case show open alcohol containers on the floor of a vehicle along with drug paraphernalia and damage to the right front of an S-U-V with dealer plates from a Rapid City car dealer.
Several charges were dismissed in a plea deal including simple assault on law enforcement for making threats to shoot the arresting police officer and resisting arrest along with several drug charges.
