SD House unable to override Governor’s veto of HB1217

South Dakota legislators are back in Pierre today, for the final day of the 2021 session.

The only agenda item so far is dealing with the Governor’s style & form veto of HB1217, the trans gender, women in sports bill.

House Speaker Spencer Gosch of Glenham issued a statement over the weekend.

Gosch says he will recommend that legislators send the bill back to the Governor.

Gosch also sent a note to legislators advising them that the Governor planned to call an immediate special session to deal with the trans gender issue.

The South Dakota House moved quickly this morning to override a style and form veto of HB1217 by Governor Kristi Noem.

She had attempted to rewrite several sections of the trans-gender, women in sports bill.

That didn’t sit well with bill sponsor, Representative Rhonda Milstead of Hartford.

Representative Jon Hansen of Dell Rapids says the Governor clearly changed the intent of the bill.

The veto was defeated by a vote of 67-2, with one excused.

The bill is returned to Governor Noem to either sign or veto.

Governor Noem’s has now officially vetoed the bill so now will require a 2/3 majority in both the House & the Senate to become law.

About 4pm the SD House fell short of the 2/3 majority needed to override the veto thus the bill is dead.
