Senate Commerce & Energy Committee passes SB88(Bossly Bill)

PIERRE, S.D.(HubCityRadio)- The South Dakota Senate Commerce & Energy Committee on Tuesday heard testimony on SB88.  The bill clarify the procedure for a potential condemnor to examine real property absent the property owner’s permission.

Prime sponsor of the bill was District 23 Senator Mark Lapka(Lap-Key).

Lapka describe how the bill follows the ruling made by the South Dakota Supreme Court in 2024.

Lapka in the landowner’s rally called this the Bossly bill named after Jared Bossly after what happened to his property.

Bossly told the committee what happened on that day back in 2023.(1:11)

Bossly’s wife Tara was in Pierre offering her support for the bill.

There was no opposition to the bill.

District 31 Senator & Committee member Randy Deibert whose career is in surveying talks about what their role is suppose to be.

The committee passed the bill on a 9-0 vote and now heads to the Senate floor.
