Senate State Affairs Committee defer SB49 to 41st day

PIERRE, S.D.(HubCityRadio)- The South Dakota Senate State Affairs Committee heard testimony on SB49.  The bill prohibit the exercise of the right of eminent domain for the construction of certain facilities.

Prime sponsor of the bill was Senator John Carley of Piedmont.

Carley explains the purpose of the bill.

Opposing the bill was lobbyist for Summit Carbon Solutions, Brett Koenecke who claims that Summit Carbon Solutions is a common carrier and that CO2 is a commodity.

That decision still has to be made by the lower courts in South Dakota.

Also opposing was Sam Nelson with the South Dakota Corn Growers Association.

Among the committee members, Senator Carl Perry expressed the most support to the bill.

Motion was made to defer it to the 41st day.  Among the supporters was Senator Tom Pischke of Dell Rapids who inform them that the focus right now should be strictly on pipelines.

The bill was deferred to the 41st day on a 7-1 vote.  The only vote opposing was Senator Carl Perry.

Senator Carley attempted to smokeout the bill Thursday and was defeated.
