Sexual allegiation against a juvenile can’t be charged because of SD State Law

PIERRE, S.D.(KCCR)- The allegations on social media are rampant.  An alleged sexual assault by a child is frustrating prosecutors.  Frustrating because of current state law.  The allegations were first brought to light through the Facebook page Lyn Seeks.  The page is a social media arm of the website lynseekstruth.com operated by former state Senator Lynne DiSanto, who is currently using the name Lyndi Meyer.  Hughes County States Attorney Jessica LaMie can’t comment on the case because she can’t file charges in the issue.

LaMie says only the legislature can change the statute to give more flexibility to prosecutors.

The information being blasted out across social media and not vetted through traditional, measured means is a frustration for LaMie.

LaMie declined to give any details at all about evidence collected during the investigation.  The only recourse for victims of the alleged crimes is in civil court.
