PIERRE, S.D.(KCCR)- South Dakota and 20 other states will not have to abide by greenhouse gas emission standards set out by the Federal Highway Administration. South Dakota Department of Transportation legal council Karla Engle says rules specifically targeted state transportation agencies.
Engle says the Texas judge ruled it the decision had nationwide application. South Dakota and other states filed a challenge to the rule in Kentucky and a judge agreed with the Texas decision.
Engle says the action can allow the Federal Highway Administration to continue trying to implement the emission rules in states not included in the action with South Dakota.
The Federal Highway Administration is intending to appeal the decision.
