SIOUX FALLS, S.D.(KELO)- Judge Brad Zell sentences Theresa Bentaas to 10 years in prison, with nine years suspended and credit for 73 days served, in the death of “Baby Andrew” in 1981.

Justin Bentaas, Theresa’s mother, testified for his mother at Thursday’s sentencing hearing.

Zell said it was inconclusive if the baby was still alive after Bentaas gave birth.

Zell said he looked at the impact of deterrence if he sentenced Bentaas to a longer prison term.

Judge Zell pronounced sentence on Theresa Bentaas in the 1981 “Baby Andrew” manslaughter case.

Zell says he knows not everyone will agree with the sentence.

Bentaas reports for prison on January 15th.
